1) Parties

This Equipment Rental Agreement (“Agreement”) is between EZiRL LLC, a WA limited liability company with its principal place of business at 11611 NE Angelo Dr Apt 110, Vancouver WA, 98684 (“EZiRL,” “we,” “us,” or “our”), and the individual or entity placing the rental order (“Renter,” “you,” or “your”).

2) Equipment & Inclusions

Each kit (the “Equipment”) generally includes:

• EZiRL custom backpack
• BelaBox Orange Pi 5 Plus (encoder)
• DJI Osmo Pocket 3 camera
• 40,000 mAh power bank
• Mounting solutions (shoulder mount and tripod/selfie stick with quick-release)
• Cables and accessories necessary for standard operation
• EZUnlimited Data + EZiRL servers included for the TwitchCon rental term

Exact contents may vary due to maintenance or availability; substantially equivalent substitutions may be provided.

3) Rental Scope & Location of Use

1. All-Day Rentals: Use is permitted inside TwitchCon venues and anywhere within the San Diego area during the rental day.
2. Hourly Rentals (Con Hall Only): Use is permitted inside the TwitchCon convention hall only. Equipment may not leave the convention premises during an hourly rental.
3. Renter agrees to comply with all venue, organizer, and platform rules, including but not limited to TwitchCon policies, venue security directives, and streaming platform terms of service.

4) Pricing & Payment

1. Pre-Order Special (Now – Oct 15): $75 per day; or $200 for all 3 days.
2. Standard Rate (Oct 16 and later): $100 per day.
3. Hourly Rate (Con Hall Only): $15 per hour. (Hourly rentals are distinct from daily rentals and do not auto-convert.)
4. Taxes/Fees: Applicable taxes and any card processing fees may be added at checkout.
5. Card Authorization: By renting, you authorize EZiRL to place a pre-authorization hold and to charge your payment method for rental fees, deposits, late fees, loss/damage, replacement costs, cleaning and recharging fees per this Agreement.
6. Security Deposit (if applicable): Deposit (if any) is released less any amounts due.

5) Reservations, Confirmation & Communication

1. After you place an order, an email with pickup and return instructions will be sent. You are responsible for ensuring your contact information is accurate and for monitoring your email (and spam folder).
2. EZiRL may contact you by email/SMS about logistics. By renting, you consent to receive such messages for operational purposes.

6) Cancellations, No-Shows & Refunds

1. You may cancel up to and including October 16 (11:59 PM PT) for a refund of rental fees paid.
2. No refunds are available after October 16 if you miss your pickup window or otherwise fail to take possession.
3. EZiRL may cancel for safety, non-payment, or unavailability; in such cases, your sole remedy is a refund of amounts paid for the affected rental period.

7) Pickup, Possession & Return

1. Pickup: You must pick up Equipment at the designated on-site location during the stated window (to be provided in your confirmation email). A government-issued photo ID and the payment card used for booking may be required.
2. Return Deadline: All Equipment must be returned by 8:00 AM PT on the calendar day following your rental day (or as stated in your confirmation). Hourly rentals must be returned at the end of the booked period.
3. Charge State on Return: Renter must return the battery, modems, and camera fully charged. Recharging fees may apply per the Fee Schedule below.
4. Early Return: No credits or refunds for early return.
5. Abandonment: Failure to return as agreed may be treated as loss/theft and charged accordingly.

8) Care, Use & Restrictions

1. Use Equipment prudently, keep it dry, avoid shocks/drops, and secure it at all times. Do not tamper with firmware or OS settings beyond basic operation.
2. Do not remove labels, engravings, or asset tags.
3. No illegal, harassing, infringing, or unsafe uses. Respect privacy and filming/recording rules; obtain consents as required.
4. Data/Servers: Included only for streaming during the rental. No tethering to unrelated devices, torrenting, malicious traffic, or bandwidth abuse. EZiRL may throttle or suspend connectivity for misuse.
5. Renter is responsible for compliance with platform and venue policies. Violations may result in immediate termination without refund.

9) Loss, Damage & Theft

1. Renter bears all risk of loss, theft, or damage (ordinary wear excepted) from pickup until return and check-in.
2. Renter will promptly notify EZiRL of any loss or damage. Fees may include repair costs or replacement at the values listed in the Fee Schedule.
3. EZiRL may charge your card on file for amounts due under this section.

11) Title; No Sale

Equipment remains the property of EZiRL. No sale or security interest is created by this Agreement.

12) Warranties; Disclaimer

Equipment is provided “AS IS.” To the maximum extent permitted by law, EZiRL disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Your exclusive remedy for any claim relating to the Equipment is limited to repair, replacement, or refund of rental fees at EZiRL’s discretion.
