EZiRL Remote Server User Agreement

Service: EZiRL “No Monthly Cost Cloud Server” Program
Jurisdiction: State of Washington, USA

This User Agreement governs the use of EZiRL’s remote servers and related services. By activating or using your EZiRL Remote Server, you agree to the terms below.

1. Ownership and Usage Rights

  • The No Monthly Cost Cloud Server program provides long-term usage rights, not ownership.
  • All server hardware, firmware, and configurations remain the sole property of EZiRL.
  • Users may not resell, lease, or transfer access or usage rights to any third party.
  • EZiRL may, when necessary, utilize the server for internal testing, network balancing, or event-based operations, provided this does not materially impact your normal use or performance.
  • If EZiRL ever discontinues the program, we may request the physical unit be returned or replaced, offering an upgrade, replacement, or prorated buyback equivalent.

2. User Responsibilities

You agree to maintain lawful, responsible use of your server. This includes:

  • Keeping your access credentials secure and private.
  • Maintaining software updates and configurations responsibly.
  • Refraining from any actions that damage, overload, or interfere with the EZiRL network.

You must not:

  • Host or distribute illegal, copyrighted, or harmful content.
  • Run torrenting, file-sharing, or public hosting services.
  • Participate in cryptocurrency mining, DDoS attacks, or network scanning.
  • Operate public proxy, VPN exit, or relay nodes.
  • Use your server for any activity that violates U.S. law or causes harm to others.

Violation of these rules may result in suspension or permanent termination of access without refund.

3. Data Privacy, Monitoring, and Security

  • EZiRL respects your privacy. We do not access your personal files or content except as needed for maintenance, troubleshooting, or abuse investigation.
  • We maintain system-level monitoring (CPU, bandwidth, uptime, and security logs) to ensure performance and integrity.
  • By using this service, you consent to limited operational monitoring as part of service functionality.
  • Users are responsible for securing their own passwords, SSH keys, and internal configurations.
  • EZiRL provides secure baseline configurations but cannot guarantee absolute protection against all cyber threats or breaches.

4. Software Licensing

Any third-party software installed on your server (e.g., OBS, SRT tools, ffmpeg, Node.js, or other utilities) remains subject to the licensing terms of its respective creators. EZiRL does not grant, extend, or transfer ownership of third-party software licenses. You are responsible for ensuring compliance with those licenses.

5. Data Responsibility

You are solely responsible for backing up any files, configurations, or recordings stored on the server. EZiRL does not guarantee data retention or recovery in the event of system failure, corruption, or accidental deletion.

6. Remote Access and Maintenance

  • Your server credentials are unique to you and should not be shared.
  • EZiRL may access your server remotely for maintenance, upgrades, or network balancing.
  • We continually roll out improvements and new systems to provide the best uptime and reliability possible.
  • Temporary interruptions may occur during updates, but we aim to minimize downtime.

7. Hardware Tampering

Users must not open, modify, overclock, or physically alter any EZiRL server hardware. Unauthorized modifications void all service support and may lead to permanent termination of access.

8. Damages and Repair Policy

If your server becomes nonfunctional due to misuse, unauthorized modifications, or physical damage caused by your actions, EZiRL will attempt repair at a rate of $30 per hour, plus parts if required. If the failure occurs under normal usage, EZiRL will cover repair or replacement at no cost.

9. Refunds, Cancellations, and Buyback Program

Refunds and cancellations follow the EZiRL Return & Replacement Policy, specifically section 9. Buyback Program: Servers, Modems, and Data SIMs, summarized below:

“Servers: EZiRL will repurchase lifetime servers at $300 per unit, reduced proportionally by any discount applied to the original purchase...”

10. Termination and Suspension

  • EZiRL reserves the right to suspend or terminate access if your server is used for prohibited or illegal purposes, or if it jeopardizes network integrity.
  • Upon termination, all server access and stored data may be deleted without notice.
  • Temporary suspensions for maintenance or network balancing may occur, with notice whenever practical.

11. Service Availability and Uptime

  • EZiRL strives to maintain continuous uptime and best-in-class performance.
  • Routine updates, upgrades, or emergency maintenance may cause brief interruptions.
  • EZiRL is not liable for downtime, latency, or losses caused by service interruptions.

12. Optional Add-Ons and Future Features

The base No Monthly Cost Cloud Server includes ongoing access without recurring fees. Optional upgrades, bandwidth tiers, or add-on services may be offered later. Declining or nonpayment for such add-ons will not affect your base access unless explicitly stated.

13. Limitation of Liability

EZiRL is not responsible for indirect, incidental, or consequential damages arising from the use or inability to use your server. You agree to hold EZiRL harmless for any data loss, service interruption, or third-party software issues. All warranties, express or implied, are disclaimed to the fullest extent permitted by law.

14. Dispute Resolution and Arbitration

Any dispute arising from this Agreement shall be resolved through binding arbitration in Clark County, Washington, under the rules of the American Arbitration Association. Each party shall bear its own costs unless otherwise required by law.

15. Governing Law

This Agreement shall be governed by and interpreted under the laws of the State of Washington, USA.
